COUNCIL MEETING - SPECIAL
TUESDAY, JULY 21, 2009, 9:30 AM
A special meeting of the Common Council of the City of Weirton, Hancock and Brooke Counties, West Virginia was held on Tuesday, July 21, 2009 at 9:30 a.m. in Council Chambers of the Weirton City Building.
Mayor Harris called the meeting to order.

Mayor Harris led everyone in reciting the Pledge of Allegiance. COMMUNICATIONS
Councilman Kondik stated that the Rotary Club has started the renovations of Marland Heights Park.
CITIZENS COMMENTS Ms. Denise Troia RE: SOUTH 24 TH STREET
Ms. Troia stated, “I want to apologize for being here, but I thought this matter had come to a reasonable conclusion with the traffic commission. I have driven every street in Weirton and I think it’s safe to say there isn’t a street that you don’t have to pull over because of a parked car. I drove in my neighborhood and all of those problems exist on every street. I feel I am being unfairly targeted in this matter. I am in favor of painting the line except for the ten feet where we park our truck.”
OLD BUSINESS
1. Ordinance to establish a yellow no parking zone on South 24th Street on the left (East) side going south beginning at the alley in the 500 block and extending 47 feet beyond the alley in the 700 block. (Councilman Dalrymple. Tabled at the June 8 and July 13 Council Meeting) A motion was made to un-table the ordinance by Councilman Dalrymple, second by Councilman Ash. Motion carried by majority, 7/0. Motion was made by Councilman Dalrymple, second by Councilman Ash. Councilman Dalrymple stated, “This area in question has been brought to my attention from many people that live out in that area as being a dangerous spot. While we were up in that area we had to dodge a couple of cars that were flying up that hill. We marked off the yellow, trying to match up what was on the other side of the road that also has been yellowed out. After I have heard Mrs. Troia’s comments about the pad that she has, I talked to the Chief of Police about this particular pad. He said to me that she can cross over that yellow curb and park on that pad because that yellow curb is put in place to keep cars from parking on the street not necessarily from parking on private property. Therefore she can park legally on that pad with that curb yellow along as her tires are not touching the road. I know that Mrs. Troia went to the traffic commission to appeal her case about that 10 foot spot, and as I said in the last meeting I would consider anything that they brought forward but in light of the fact that talking to the Chief of Police she would not be fined or ticketed for parking on that private pad behind that curb I don’t see any reason why we should take that 10 feet out. If we take that 10 feet we mine as well not even do anything because that’s right at the crest of the hill. It’s a dangerous spot that needs to be addressed. I don’t why it hasn’t been addressed before, but it something that I feel needs to be done.”
Mayor Harris stated, “In the traffic commission, one of the comments that I made was if part of her vehicle was sitting out on the yellow curb line would it be illegal. At that time it would be illegal. We didn’t know how wide her pad is, and I don’t if she is going to be able to get her whole vehicle on the pad without her tire hanging over.” Councilman Ash stated, “I have never known the police department to give a ticket to a person who has their vehicle parked on their property. So I don’t understand what the problem. You go all of through the city especially downtown and there are yellow lines everywhere. You still have the parking problems and you’re going to always have them. I know the police department is not going to give a ticket to someone who is parked on their property so I will support because of that.” Motion passed by majority, 7/0.
NEW BUSINESS
1. Resolution to authorize City Manager to enter into a memorandum of understanding with the Hancock County Commission for the filing of a Justice Assistance Grant Application with the United States Department of Justice for funding for the Weirton Police Department and Hancock County Sheriff’s Department. Motion was made by Councilman Ash, second by Councilman Fijewski. Motion passed by majority, 7/0.
ADJOURNMENT
With no further business before this July 21, 2009 special session of the Weirton City Council the meeting was adjourned after the closing prayer.
