COUNCIL MEETING - SPECIAL

 

Tuesday, April 17, 2007 9:00 A. M.

 

A special meeting of the Common Council of the City of Weirton, Hancock and Brooke Counties, West Virginia was held on Tuesday, April 17, 2007 at 9:00 A.M. in Council Chambers of the City of Weirton Municipal Building.

 

Mayor Miller called the meeting to order.

Mayor Miller led the Pledge of Allegiance.

 

 

NEW BUSINESS

 

 

Resolution:

TO ADOPT THE LEVY RATES FOR THE 2007-2008 FISCAL YEAR.

 

Motion was made by Councilmember J. Miller, second by Councilmember Veltri.

The motion passed by majority, 6/0

 

RESOLUTION

CITY OF WEIRTON

OFFICIAL LEVY RATES

 

 

STATE OF WEST VIRGINIA,

MUNICIPALITY OF WEIRTON, to-wit:

 

WHEREAS, in accordance with West Virginia State Code §11-8-10a, 11-8-14a, with the Levy Estimate (Budget) approved by the State Auditor, the levying body must meet on the third Tuesday in April to officially lay the levy; and

 

WHEREAS, the levying body has met to hear public objections in accordance with West Virginia State Code provisions.

 

NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF WEIRTON, BROOKE AND HANCOCK COUNTIES, WEST VIRGINIA, that the levy rates of:

 

Class I Rate                 $.1250/$100

Class II Rate               $.2500/$100

Class IV Rate              $.5000/$100

 

which were approved in writing by the State Auditor are hereby officially adopted.

Resolution:

TO AUTHORIZE THE CITY MANAGER TO ENTER INTO CONTRACT FOR ENGINEERING SERVICES FOR THE INITIAL PHASE OF THE PENCO ROAD IMPROVEMENT PROJECT.

 

Motion was made by Councilmember Kondik, second by Councilmember Veltri.

 

Councilmember Dalrymple commented, “This is just basically the engineering study to do the job, not necessarily to authorize to have the job done.”

 

Mayor Miller commented, “We have funding from Streetscape.  The City’s matched that funding, and the additional engineering services to find out how we can tie both of them in there.”

 

Councilmember Moore commented, “At this point though, there is no funding for Phase 2 of the project which is the drainage, the removal of the present street, installation of drainage and replacement of the street surface.  So, without other funding that part of the project is not ready to move forward at this time.”

 

Mayor Miller commented, “That is correct Councilman.  Would the City Manager like to make any comments on this?”

 

Mr. DuFour commented, “Councilman Moore sort of hit the nail on the head.  The object of the resolution is to authorize entering into contract with HDR Engineering and the agreement with sub-consultant J. T. Sauer and Associates.  They are landscape architects.  Mr. Sauer lives in Weirton as a matter of fact.  He will be doing the actual streetscape design.  This is solely design work.  We do not have the funding commitment for the street paving or the (unintelligible).”

 

The motion passed by majority, 6/0.

 

RESOLUTION

 

TO AUTHORIZE CITY MANAGER TO ENTER INTO CONTRACT WITH HDR ENGINEERING, INC. FOR ENGINEERING SERVICES FOR INITIAL PHASE OF PENCO ROAD ENHANCEMENT PROJECT

 

WHEREAS, the City of Weirton is proceeding with plans for improvements to Penco Road; and,

 

WHEREAS, summaries of qualifications were submitted by various engineering firms, which were reviewed by a staff committee; and,

 

WHEREAS, it was determined by the committee that HDR Engineering, Inc. be offered the contract for the project, which is to be funded utilizing funding from the West Virginia Transportation Enhancement Grant as well as the City of Weirton’s General Fund; and,

 

WHEREAS, HDR Engineering, Inc. has submitted an estimated cost of Sixty Six Thousand One Hundred Thirty Three Dollars ($66,133.00) for the initial design phase of the project, which includes Streetscape Design - $28,095.00 (funded through Transportation Enhancement Grant allocation) and Road/Drainage Improvement Design - $38,038.00 (funded utilizing General Fund allocation).

 

NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF WEIRTON, BROOKE AND HANCOCK COUNTIES, WEST VIRGINIA, that the City Manager be authorized to enter into contract with HDR ENGINEERING, INC., 333 Penco Road, Weirton, WV  26062 for the initial design phase of improvements to Penco Road, as outlined in the contract which is attached hereto and made a part thereof.

Mayor Miller commented, “Right now, I’d like to entertain a motion to reconvene the canvassing board.”

 

Motion was made by Councilmember J. Miller, second by Councilmember Moore.

 

The motion passed by majority, 6/0.

 

Mr. Maher commented, “We did have two additional items to discuss with the Board of Canvassers for the 2007 City of Weirton Municipal Election.  One being the addition of the total number of voters for each precinct that was not included during the canvass.  In front of the Councilmen, I have included that information, and that would need to be approved to be added to the minutes of the canvass.  So, I’ll need the Canvassing Board to approve that information.”

 

Motion was made by Councilmember Kondik, second by Councilmember J. Miller.

 

The motion passed by majority, 6/0.

 

Mr. Maher commented, “The second item that we had, and we did discuss it with members of the Canvassing Board.  During the canvass, some items were mixed in with some of the newer empty envelopes, and there was an additional envelope that was missed, a provisional ballot that was missed during the count.  That being said, the information on the ballot is correct.  What I would need the Canvassing Board to do is to approve or disapprove the envelope.  You will notice a couple of things on the envelope.  It does look to have been opened on two edges, and re-taped shut.  So, I’ll pass that around to the Canvassing Board for them to review, and then you can vote weather to accept it or reject it.”

 

Councilmember H. Miller commented, “We had some similar situation during the canvassing, and we decided not to accept it during canvassing.  It set precedent.  It looks like it’s been tampered or opened and re-sealed.”

 

Mr. Maher commented, “We don’t know the reason that it would have been opened, and because we don’t know that, and without talking to the people at the polling place, we wouldn’t know.”

 

Councilmember J. Miller commented, “I agree with Councilman Miller.  We already had one of these situations.  I think we definitely set a precedent on that.”

 

Mayor Miller commented, “Kitty or Bill.  Do you have any comments to make on this?”

 

Mr. Moss commented “I believe that it should not be counted, because it could have been tampered with by someone else in the voting precinct.”

 

Mrs. Kochman commented, “Right.”

 

Motion was made by Councilmember Kondik to deny it by the Canvassing Board, second by Councilmember J. Miller.

 

The motion passed by majority, 6/0.

 

Mr. Maher commented, “We do need to certify the results of the election.  I’ll go ahead and read them, present them to you.  This is the Canvassers Certificate of Votes Cast for the Primary Election.  This was the primary election held on April the 3rd of 2007.

For the position of Mayor, William M. Miller received 1,194 votes.  Mark Harris received 2,880.  John Good received 560 votes.

 

For the position of Ward I Council, Ronnie Jones received 392 votes.  Charlie Mitchell received 164 votes.  Jerry Miller received 117 votes.

 

For Ward II Council, Norman McClements received 275 votes.  Harold Miller received 294 votes.

 

For Ward III Council, Fred Marsh received 441 votes.  Dale Moore received 222 votes.

 

For Ward IV Council, George Vacheresse received 82 votes.  George Ash, Sr. received 167 votes.  Henry DeMasis received 70 votes.

 

For Ward V Council, Jonathan Brown received 257 votes.  George Kondik received 494 votes.

 

For Ward VI Council, David Dalrymple received 468 votes.  He was unchallenged.

 

For Ward VII Council, Max Fijewski received 445 votes.  Frank Veltri received 334 votes.

 

This does need to be signed by the Board of Canvassers.  The information is all contained.  In addition, the total voters I passed out to you.  Ward I had a total number of voters of 256…Ward I, Precinct I had a total number of voters of 256; Ward I, Precinct II, 290; Ward I, Precinct III, 55 voters; Ward II, Precinct I, 262 voters; Ward II, Precinct II, 310 voters; Ward III, Precinct I, 183 voters; Ward III, Precinct II, 207 voters; Ward III, Precinct III, 256 voters; Ward IV, Precinct I, 120 voters; Ward IV, Precinct II, 86 voters; Ward IV, Precinct III, 88 voters; Ward V, Precinct I, 206; Ward IV, Precinct II, 218; Ward V, Precinct III, 311; Ward VI, Precinct I, 312; Ward VI, Precinct II, 255; Ward VII, Precinct I, 255; Ward VII, Precinct II, 303; Ward VI, Precinct III, 214.

 

That brings the total voter turnout to 4,187 votes.”

 

Councilmember Kondik commented, “What was the percent?  How many voters do we have in the City?”

 

Mayor Miller commented, “Thirteen thousand.”

 

Councilmember Kondik commented, “Thirteen thousand?”

 

Mr. Maher commented, “Yes.  Just over thirteen thousand.”

 

Councilmember Kondik commented, “It’s got to be the lowest voter turnout that I can remember.”

 

Councilmember J. Miller commented, “In Ward I, we’ve got 1,800 voters registered, and 601 voted.  That’s terrible.  That’s a third of the voters.”

 

Councilmember Kondik commented, “I think that’s probably in the twenties, like 25%, isn’t it?”

 

Mayor Miller commented, “Well, between 25 and 30.  You need a motion.  Don’t you Tom?”

 

Mr. Maher commented, “We’ll need a motion to accept the results, and then a vote.  Absolutely.”

 

Motion was made by Councilmember Moore, second by Councilmember J. Miller.

 

The motion passed by majority, 6/0.

 

ADJOURNMENT

 

 

With no further business before this April 17, 2007 special session of the Weirton City Council the meeting was adjourned after the closing prayer.
