COUNCIL MEETING - REGULAR
MONDAY, NOVEMBER 9, 2009 7:00 P.M.
A regular meeting of the Common Council of the City of Weirton, Hancock and Brooke Counties, West Virginia was held on Monday, November 9, 2009 at 7:00 P.M. in Council Chambers of the Weirton City Building.
Mayor Harris called the public hearing to order.

Mayor Harris led everyone in reciting the Pledge of Allegiance.
APPROVAL OF MINUTES
A motion was made by Councilmember Ash and second by Councilmember Jones to approve the minutes of the: October 13, 2009 –Regular Council MeetingThe motion carried by majority, 6/0.
MAYOR’S AWARDS AND PROCLAMATIONS
Mayor Harris stated that Councilman Kondik had informed him of an individual who had volunteered her services for many years and wanted her hard work and dedication recognized. The Mayor issued an award to Ms. Jeannie Duffy for 13,000 hours of volunteer work as well as being named WMC Auxiliary of the Year.
Mayor Harris issued an award to Duke Horstmeyer for his volunteer work as well as 35 years served on the library board.
Mayor Harris issued a plaque to the WV Chapter VI Red Knights Motorcycle Club recognizing all of their volunteer and charity work.
PUBLIC HEARING
There were no citizens wishing to speak at the public hearing regarding the authorization of improvements to the public water works system.
John Stump, legal council for the water board spoke on behalf of the board addressing City Council and answering all questions regarding the legislation of the water bonds.
CITIZEN’S REMARKS
Herbert Veal Re: Presentation to Councilman Jones
Mr. Veal issued Councilman Jones a plaque stating that the members of his ward appreciated the hard work the Councilman had put in to rectifying the problem of their neighborhood.
COMMUNICATIONS
Mayor Harris congratulated the Weir High Boys and Girls soccer teams as well as Brooke and Madonna High school for their athletic achievements.
OLD BUSINESS
Third reading of Ordinance No. 1661 authorizing the acquisition and construction of additions, betterments, and improvements to the existing Public Water Works System of the City of Weirton and the financing of the cost through the issuance by the City of not more than $3,000,000 in aggregate principal amount of water revenue bonds. Motion was made by Councilman Ash, second by Councilman Jones. The motion passed by majority, 5/1 with Councilman Dalrymple opposing.
Second reading of Ordinance No. 1664 amending Ordinance No. 1288 to eliminate the police and fire service appeals board. Motion was made by Councilman Fijewski, second by Councilman Ash. The motion passed by majority, 6/0.
NEW BUSINESSOrdinance No. 1665, Amendment No. 728 to rescind Ordinance No. 1504, Amendment No. 657 of the traffic control map which established a dedicated residential disability parking space for resident at 234 School Street. Motion was made by Councilman Dalrymple, second by Councilman Ash. The motion passed by majority, 6/0.
Resolution to enter into contract for lease-purchase of two (2) 2010 Ford Crown Victoria Police Cruisers and one (1) 2010 Ford Expedition for the Weirton Police Department utilizing State of West Virginia purchasing contract. Motion was made by Councilman Ash, second by Councilman Marsh. The motion passed by majority, 6/0.
Resolution to enter into contract for the purchase of a Two-way mobile radio for the Police Department. Motion was made by Councilman Ash, second by Councilman Marsh. The motion passed by majority, 6/0.
Resolution to amend contract for 2009 City of Weirton milling and paving. Motion was made by Councilman Ash, second by Councilman Jones. The motion passed by majority, 6/0.
Resolution to award bids for the Greenbrier Bridge Project Motion was made by Councilman Marsh, second by Councilman Ash. The motion passed by majority, 6/0.
Resolution providing as to principal amount, date, maturity date, redemption provision, interest rate, interest and principal payment dates, sale price and other terms of the Water Revenue Bonds. Motion was made by Councilman Ash, second by Councilman Jones. The motion passed by majority, 5/1 with Councilman Dalrymple opposing.
Resolution approving invoices relating to the acquisition and construction and other services for the proposed water project and authorizing payment thereof. Motion was made by Councilman Ash, second by Councilman Jones. The motion passed by majority, 5/1 with Councilman Dalrymple voting against.
Resolution establishing electronic payments for Water Revenue Bonds to the West Virginia Municipal Bond Commission. (Sweep Resolution) Motion was made by Councilman Jones, second by Councilman Ash. Concerns were discussed regarding the resolution’s requirements monthly payments by electronic funds transfer. It was advised by John Stump that any delay in passing of the legislation would be detrimental to the overall process of issuing bonds.
A roll call vote was asked by the mayor: Councilman Kondik- Yes Councilman Fijewski- Yes Councilman Dalrymple- No Councilman Marsh- No Councilman Jones- Yes Councilman Ash- No Mayor Harris broke the tie by voting yes The motion passed by majority, 4/3.
Resolution for GASB 34 Accounting Services. Motion was made by Councilman Marsh, second by Councilman Ash. The motion passed by majority, 6/0.
Ordinance to establish yellow “No Parking” curb line on the west side of Bell Street starting at Concord Court and extending 160 feet to the driveway at 120 Bell Street. (Traffic Commission Recommendation. Based upon the request of Councilman Dalrymple) Motion was made by Councilman Dalrymple, second by Councilman Fijewski. The motion passed by majority, 6/0.
Ordinance to establish yellow “No Parking” curb line on the east side of Bell Street starting at Concord Court and extending 110 feet North towards School Street and another 43 feet on the East side of Bell Street starting at the alley and ending at the driveway of 127 Bell Blvd. (Traffic Commission Recommendation. Based upon the request of Councilman Dalrymple.) Motion was made by Councilman Dalrymple, second by Councilman Jones. The motion passed by majority, 6/0.
Ordinance to establish parking restrictions within Ward II regarding Country Club BLVD. Traffic Commission Recommendation. Based upon the request of Director of Transportation for Hancock County Schools and Councilman Harold Miller.) Motion was made by Councilman Marsh, second by Councilman Ash. The motion passed by majority, 5/0/1 with Councilman Fijewski abstaining.
APPOINTMENTS TO VARIOUS BOARDS AND COMMISSIONS
ADMINISTRATIVE REPORTS:
SANITARY/WATER-
Mr. Mastrantoni stated that he nothing to report.
POLICE DEPARTMENT-
Chief Marshall stated that he had nothing further to add.
PUBLIC WORKS-
Mr. Brown stated he had nothing further to report. Councilman Fijewski voiced his appreciation for painting the yellow lines on Palm Drive.
PARKS AND RECREATION –
Mr. Weigel stated they have begun renovations to the Rose Room. They are waiting for the delivery of the air-conditioning units, which are set to be delivered around the end of the month. Once the rose room is 100% complete they will move to the old lobby area and begin to do the renovations in there.
CODE-
Mr. Rosnick stated that he had nothing further to report. Councilman Ash stated, “I talked to the City manager a couple weeks ago. Is your department still complaint driven or are you guys being proactive?”
FIRE-
Chief Lashhorn stated that he had nothing additional to report.
LIBRARY-
Mr. Rekowski stated that he was here to remind everyone that October 17 is the Brooke County Excess Levy renewal. Some of the revenues generated by the levy will benefit the Mary H. Weir public library. October 28 is the free movie night at 6:00.
FINANCE DEPARTMENT-
Mr. Maher stated: General Fund cash report for September 2009:

The Mayor called for a motion to pay any bills and accept administrative reports from all of the departments. Motion was made by Councilman Marsh, second by Councilman Fijewski. The motion carried by majority, 6/0.

The mayor called for a motion to adjourn. Motion was made by Councilman Dalrymple, second by Councilman Fijewski. The motion passed by majority, 6/0.
With no further business before this November 9, 2009 regular session of the Weirton City Council the meeting was adjourned after the closing prayer.
