COUNCIL MEETING - REGULAR

 

MONDAY, AUGUST 10, 2009 7:00 P. M.

 

A regular meeting of the Common Council of the City of Weirton, Hancock and Brooke Counties, West Virginia was held on Monday, August 10, 2009 at 7:00 P.M. in Council Chambers of the Weirton City Building.

 

City Clerk Nicole Davis called the meeting to order in the absence of Mayor Harris.

APPROVAL OF MINUTES

 

A motion was made by Councilman Ash and second by Councilman Marsh to approve the minutes of the:

July 13, 2009 –Regular Council Meeting

The motion carried by majority, 5/0/1 with Councilman Dalrymple abstaining.

 

A motion was made by Councilman Ash, second by Councilman Marsh to approve the minutes of the:

July 21, 2009-Special Council Meeting

The motion carried by majority, 6/0.

 

 

 

 

MAYOR’S AWARDS AND PROCLAMATIONS

 

No awards or proclamations were issued.

 

COMMUNICATIONS

 

Councilman Fijewski stated that council has gotten together to form a task force to review the current committees, boards, or commissions.  The last time we checked we had 24.  The Mayor has appointed three of us to do that, and we are scheduled to meet this Thursday.  I hope to bring to council some recommendations. Councilman Fijewski stated that he would like to express his thanks to Senator Bowman for the beautification project that has been completed coming from Pennsylvania in to Weirton on both of the exits.  Councilman Fijewski stated that he would like to personally thank John Greco for adopting the park on Colliers Way.

Mr. Matt Provenzano

Re: Change Inc. Parking Lot Lease

Mr. Provenzano discussed issues he was having regarding parking at his business due to the Change Lease Inc. agreement.   

 

Ms. Karen Harris

Re: Weir Ave, Marland Heights, Pennsylvania Ave.

Ms. Harris made several statements and asked questions regarding low income housing and what was being done to assist families and individuals.

 

Mr. Lester McHenry

RE: Committees

Mr. McHenry discussed the issues he had with members of Council being appointed to the various boards, believing it was an insult to the citizens serving on these boards.  He also voiced his displeasure in reducing the number of individuals serving on the boards.  Councilman Fijewski corrected Mr. McHenry stating that the Council was planning on adding members to the boards in discussion not taking away.

 

OLD BUSINESS

 

Second reading of Ordinance No. 1647 to change the 2-Way stop to a 4-Way stop on Rothrock Avenue and its intersection with State Street. (Traffic Commission Recommendation.  Based upon the request of Councilman Kondik)

Motion was made by Councilman Kondik, second by Councilman Ash.

The motion passed by majority, 6/0.

 

Second reading of Ordinance No. 1648 to extend the yellow no parking zone in the 600 block of North 10th Street on the east side of the street an additional 370 feet. (Councilman Jones)

Motion was made by Councilman Jones, second by Councilman Ash.

The motion passed by majority, 6/0.

 

Second reading of Ordinance No. 1649, amendment No. 725 to rescind Ordinance No. 1542, Amendment No. 668 of the Traffic Control Map which established a handicapped parking space at 4114 Brooke Street. (Traffic Commission Recommendation)

Motion was made by Councilman Ash, second by Councilman Jones.

The motion passed by majority, 6/0.

 

Second reading of Ordinance No. 1650 to permit Council to approve the removal of handicapped parking spaces with one reading of the ordinance. (Councilman Ash)

Motion was made by Councilman Ash, second by Councilman Jones.

The motion passed by majority, 6/0.

 

Second reading of Ordinance No. 1651 to repeal Ordinance No. 1553 which established the Weirton Youth Advisory Committee. (Councilman Fijewski)

Motion was made by Councilman Fijewski, second by Councilman Ash.

The motion passed by majority, 6/0.

 

Second reading of Ordinance No. 1652 to repeal Ordinance No. 1103 which established the Weirton Beautification Committee. (Councilman Fijewski)

Motion was made by Councilman Fijewski, second by Councilman Ash.

The motion passed by majority, 5/1 with Councilman Jones opposed.

 

Second reading of Ordinance No. 1653 to rescind Ordinance No. 111 and permit the Weirton Library Board to increase its members by one to include and require a member from Council appointed by the Mayor. (Councilman Fijewski)

Motion was made by Councilman Kondik, second by Councilman Fijewski.

Motion was made by Councilman Ash to remove the autonomy of the board.  The motion died for lack of a second.

The original motion passed by majority, 4/2 with Councilmen Jones and Dalrymple opposed.

 

Second reading of Ordinance No. 1654 to repeal Ordinance No. 150 which established the Municipal Parking Board. (Councilman Fijewski)

Motion was made by Councilman Fijewski, second by Councilman Kondik.

The motion passed by majority, 6/0.

 

Second reading of Ordinance No. 1655 to permit the Weirton Redevelopment Authority (WRA) to increase their number of members by one to include and require a member of Council appointed by the Mayor for their term of office. (Councilman Fijewski)

Motion was made by Councilman Fijewski, second by Councilman Marsh.

The motion passed by majority, 4/2 with Councilmen Jones and Dalrymple opposed.

 

Second reading of Ordinance No. 1656 to permit the Weirton Port Authority to reduce their number of members from seven (7) to five (5) members and require that one member be a Council member appointed by the Mayor for their term of office. (Councilman Fijewski)

Motion was made by Councilman Fijewski, second by Councilman Kondik.

The motion passed by majority, 4/2 with Councilmen Jones and Dalrymple opposed.

 

Second reading of Ordinance No. 1657 amending Article 331.01 of the Code of the City of Weirton.

Motion was made by Councilman Ash, second by Councilman Marsh.

The motion passed by majority, 6/0.

 

Second reading of Ordinance No. 1658 to establish a yellow no parking zone on South 24th Street on the left (East) side going South beginning at the alley in the 500 block and extending 47 feet beyond the alley in the 700 block. (Councilman Dalrymple)

Motion was made by Councilman Dalrymple, second by Councilman Fijewski.

The motion passed by majority, 6/0.

 

Ordinance to rescind Ordinance No. 1317 and permit the Weirton Water Board to increase their number of members by one and require a member of Council appointed by the Mayor. (Councilman Fijewski)

Motion was made by Councilman Fijewski, second by Councilman Ash to remove item from the table.

The motion passed by majority, 6/0.

Motion was made by Councilman Fijewski, second by Councilman Marsh.

Motion was made by Councilman Ash to amend the Ordinance and remove the autonomy from the board.

Motion died for lack of second.

Resolution to enter into contract for painting of County Road Fire Station.

Motion was made by Councilman Jones, second by Councilman Ash.

The motion passed by majority, 5/1 with Councilman Fijewski opposed. 

 

Resolution to enter into contract for purchase of road de-icing salt for the 2009-2010 winter season.

Motion was made by Councilman Kondik, second by Councilman Marsh.

The motion passed by majority, 6/0. 

 

Resolution authorizing application and acceptance for West Virginia Legislative Digest Funds. (Thomas E. Millsop Community Center)

Motion was made by Councilman Fijewski, second by Councilman Kondik.

The motion passed by majority, 6/0.  

 

 

 

Resolution to enter into contract for the purchase of brochures and field guides for MS-4 erosion and sediment control information.

Motion was made by Councilman Ash, second by Councilman Jones.

The motion passed by majority, 6/0.

 

Resolution to enter into contract for the purchase of municipal signs for the City of Weirton.

Motion was made by Councilman Marsh, second by Councilman Ash.

The motion passed by majority, 6/0.

 

Resolution to enter into contract for the purchase of line stripping for the City of Weirton streets

Motion was made by Councilman Kondik, second by Councilman Ash.

The motion passed by majority, 6/0.

 

Ordinance accepting through a governmental transfer property from the Board of Education of the county of Hancock, West Virginia property located at the intersection of Orchard Street and Virginia Avenue.

Motion was made by Councilman Ash, second by Councilman Marsh.

The motion passed by majority, 6/0.

 

Ordinance to establish a residential disability parking space at 3340 Overbrook Drive. (Councilman Jones)

Motion was made by Councilman Jones, second by Councilman Ash.

ADMINISTRATIVE REPORTS

 

 

 

 

POLICE DEPARTMENT-

 

Chief Marshall stated that he had nothing further to add.

 

 

PUBLIC WORKS-

 

Mr. Brown stated that Clark Kelly Paving is back to paving and should be done by the end of the month.

 

PARKS AND RECREATION –

 

Mr. Weigel stated that they have finished re-paving and sealing the tennis courts at Marland Heights.  They have completed 2 out of 3 tennis courts at Starvaggi Park.  The biggest hold up is needing 5 days in a row without any rain to finish the project.  He also acknowledged the Weir High School Honor Society for donating their time cleaning up Marland Heights Park.  The Rotary Club also volunteered their services towards the up keep of Marland Heights Park.

Mr. Mastrantoni stated that he had nothing further to add.

Mr. Rosnick stated that he had nothing additional to add.

Councilman Fijewski stated that he was unsatisfied with the way the City was keeping its financial budget stating, “I defy anyone that can look at these reports and tell me what they say.”  He is considering a resolution to be put before Council regarding changing the way the budget is being handled.  He also stated that he would like Council to consider implementing a software system to assist in the accounting.  He would like a monthly budget as opposed to yearly.

 

Motion was made to pay any unpaid bills by Councilman Marsh, second by Councilman Kondik.

City Clerk called for a motion to approve administrative and financial reports.

Motion was made by Councilman Ash, second by Councilman Kondik.

The motion passed by majority, 5/1 with Councilman Fijewski opposed.
