REGULAR SESSION A regular session of the Common
Council of the City of Councilmen in attendance were
Jerry Miller, Harold Miller, Dale Moore, Henry DeMasis, George Kondik, David
Dalrymple, and Frank Veltri. Present
from the City were Gary DuFour, Valerie Means, Mayor Miller led the Pledge of Allegiance. MINUTES Mayor Miller advised that the minutes from the March 13, 2006, regular session needed to be amended to read that the public hearing for the Bond Ordinance would be April 10, not April 5. With this change, it was moved by Councilman Kondik and seconded by Councilman Jerry Miller to approve the minutes for the March 13, 2006, regular session; this passed unanimously. It was then moved by Councilman Jerry Miller and seconded by Councilman Veltri to approve the minutes from the March 20, 2006, special session; this passed unanimously. MAYOR’S AWARDS AND PROCLAMATIONS Mayor Miller read a proclamation setting April as Fair Housing Month. COMMUNICATIONS There were no communications. CITIZENS COMMENTS Cheryl Chief Scott brought up that the
Police cannot dictate what happens on private property to the owner of that
property. He advised that the Department
has been instructed to make checks of the Mr. Yeager talked about doing a
press release advising that it is a crime to take down no trespassing signs;
the property is still no trespassing even if the signs have been torn
down. Councilman Jerry Miller talked
about adding ATV rules to the press release.
Mr. Yeager brought up the question of whether allowing the use of
private property in such a fashion constitutes a public nuisance. Councilman Harold Miller brought up possibly
creating an area in Madeline Leasure, 150 N. 20 Councilman Moore advised that Council cannot do anything about a tree on private property. Ms. Leasure advised the tree was dead. Councilman Moore advised that the tree is not dead if it is producing the spinners. Mr. Yeager agreed that the City cannot do anything about a live tree on private property. He advised that she could cut down any branch that is over her property. Mr. Rosnick advised that the tree in question is alive and is across the street from Ms. Leasure’s residence. Mayor Miller agreed also about the private property issue. Victor Greco and Dr. Luthra: Mr. Greco advised that the Dr. Luthra requested to appear at
Council next month to present to Council the need for a museum in Mayor Miller brought up that in
the 1990s renovations at OLD BUSINESS Third reading of Ordinance No. 1482 authorizing the acquisition and construction of additions, betterments and improvements to the existing Public Waterworks System of the City of Weirton and the financing of the cost, not otherwise provided thereof through the issuance by the City of not more than $3,500,000 in aggregate principal amount of Water Revenue Bonds, Series 2006A (West Virginia DWTRF Program); providing for the rights and remedies of the security for the registered owners of such Bonds; authorizing execution and delivery of all documents relating to the issuance of such Bonds; approving, ratifying, and confirming a loan agreement relating to such Bonds; authorizing the sale and providing for the terms and provisions of such Bonds and adopting other provisions relating thereto: It was moved by Councilman Kondik and seconded by Councilman DeMasis to approve this Ordinance at third reading; this passed unanimously. Second reading of Ordinance No. 1481 as amended, an Ordinance amending the codified Ordinances of the City of Weirton by amending Part 5, General Offenses Code, by adding Article 509.11, “Public Nuisances:” It was moved by Councilman Jerry Miller and seconded by Councilman DeMasis to approve this Ordinance at second reading; this passed unanimously. NEW BUSINESS Resolution providing as to principal amount, date, maturity date, redemption provision, interest rate, interest and principal payment dates, sale price and other terms of the Water Revenue Bonds, Series 2006A (West Virginia DWTRF Program), of the City of Weirton; approving and ratifying the Loan Agreement relating to such bonds and the sale and delivery of such bonds to the West Virginia Water Development Authority; designating a registrar, paying agent, and depository bank; and making other provisions as to the bonds: It was moved by Councilman Veltri and seconded by Councilman DeMasis to approve this Resolution; this passed unanimously. Resolution of the City of Resolution to pass legislation for Open Governmental Proceeding Rules: It was moved by Councilman Moore and seconded by Councilman Dalrymple to approve this Resolution; this passed unanimously. Resolution to enter into agreement with the West Virginia Department
of Transportation for the Transportation Enhancement Program for Resolution to authorize City of Weirton to enter into Agreement with the Office of Economic Opportunity for the Emergency Shelter Grants Program for fiscal year 2006-07: It was moved by Councilman Jerry Miller and seconded by Councilman Veltri to approve this Resolution authorizing the City Manager in conjunction with Change, Inc., to enter into contract with the WV Office of Economic Opportunity for the Emergency Shelter Grants Program for the Lighthouse Domestic Violence Shelter in the amount of $15,000; this passed unanimously. Resolution to enter into contract for purchase of scuba equipment
for dive team: It was moved by
Councilman Moore and seconded by Councilman Dalrymple to approve this
Resolution authorizing the City Manager to enter into contract with T.L. Velas
Diving and Supply of Wheeling, WV, in the amount of $9,500, and that the
purchase be made using funding from West Virginia insurance premium
allocations. Councilman Moore asked
Chief Cole to confirm how long staff would have to wait in an emergency for a
dive team from outside the City to arrive at the scene. Chief Cole advised that divers would have to
come from Resolution to enter into contract for repairs to First Reading–Ordinance establishing Citizens with Disabilities Advisory Committee: It was moved by Councilman Harold Miller and seconded by Councilman Veltri to approve this Resolution. Councilman Harold Miller advised that he is aware of the need for assistance for citizens with various disabilities throughout the City. This would put together a Committee to bring recommendations to Council; he would also like to get cooperation from businesses. Councilman Dalrymple also spoke about the need for assistance for the disabled; he would like to serve on the Committee. The vote was held on the first reading of this Ordinance; this passed unanimously. First Reading–Ordinance modifying Section 553.02 of the General
Offenses Code of the City of Resolution to enter into contract for purchase of four tazers for Weirton Police Department: It was moved by Councilman Harold Miller and seconded by Councilman Veltri to approve this Resolution authorizing the City Manager to enter into contract for the purchase of four tazers and appropriate training using funds donated by the Association of Limited Video Lottery owners. Councilman Dalrymple asked Chief Scott about safety procedures. Chief Scott advised that he will be preparing the guidelines and a use of force form, and will have them in place before these weapons are issued and used on turns. These guidelines will be strictly adhered to. Councilman Moore pointed out that the funds were donated; also, these will not be used until the City finds out from the insurance carrier about liability. Chief Scott agreed. Chief Scott advised that two officers had been sent for this training; these had been paid out of the Department’s training budget. Councilman Dalrymple asked if one tazer would be on each turn; Chief Scott agreed with this. The vote on this Resolution was held; this passed unanimously. Resolution to authorize City Manager to accept the Resolution to enter into contract to provide prevention/retention
officer (PRO) at Resolution to authorize City Manager to accept the West Virginia Division of Justice Services Direct Award through collaboration with the Hancock County Commission and provide the associated cash match to continue to provide funding for personnel serving on the Hancock, Brooke, Weirton Multi-jurisdictional Drug Task Force: It was moved by Councilman Kondik and seconded by Councilman Dalrymple to approve this Resolution. Mayor Miller brought up that this is also affected by federal budget cuts; citizens were again urged to contact their legislators. The vote on this Resolution was held; this passed unanimously. Resolution to accept contract for Legislative Digest Funds (Weirton Police Department Special Response Team): It was moved by Councilman Jerry Miller and seconded by Councilman Dalrymple to approve this Resolution to authorize the City Manager to accept the contract for $9,000 in Legislative Digest funds for the Special Response Team. This passed unanimously. Resolution to accept contract for Legislative Digest Funds for the E.J. Bowman Baseball Field: It was moved by Councilman Moore and seconded by Councilman Veltri to approve this Resolution to authorize the City Manager to accept the contract for $11,500 in Legislative Digest funds for the Bowman Baseball Field; this passed unanimously. Resolution authorizing participation in the Northern Panhandle Home Consortium for the period of July 1, 2006, to June 30, 2007: It was moved by Councilman Jerry Miller and seconded by Councilman Dalrymple to approve this Resolution; this passed unanimously. BOARDS AND COMMISSIONS Mayor Miller put forth Tom Maher to be appointed as city clerk, to start April 13, 2006. It was moved by Councilman DeMasis and seconded by Councilman Dalrymple for this appointment; this passed unanimously. Councilman Moore asked if Mr. Maher would have to serve a probationary period since he has held this position in the past; Mayor Miller advised he would not. ADMINISTRATIVE REPORTS Utilities: Mr. Mastrantoni advised that staff is continuing to restore areas where work had occurred throughout the winter. So far, 20 yards of concrete have been poured, and at least 40 tons of blacktop have been put down. This work is continuing. Mayor Miller asked for a list of the areas; Mr. Mastrantoni will have this information sent to him. Councilman Dalrymple asked about the bottom of 11 Street; Mr. Mastrantoni advised that staff is getting the worst areas first. Fire: Chief Cole
had nothing additional to report. Police: Chief Scott had nothing additional to report. He did thank Council for their recognition of the importance of the PRO program and the Drug Task Force officers. Inspections: Mr. Rosnick advised that there had been a partial collapse of a building because of the Overbrook slip. Demolition for this is set for Wednesday. Library: Mr. Rekowski advised he had attended the West Virginia Library Commission meeting. The State will be receiving support from the Gates Foundation for computer upgrades. The Mary H. Weir Public Library will be part of this. Mr. Rekowski talked about the need for the Library to replace some of the public use computers. Councilman DeMasis thanked the Library employees for their help during the Toys for Tots campaign. Park Board: Mr. Weigel recognized Councilman Moore being named coach of the year. TREASURER’S REPORT Ms. Means gave the treasurer’s report. She also advised that there were no additional bills for approval. It was moved by Councilman Jerry Miller and seconded by Councilman Dalrymple to accept the administrative reports and the treasurer’s report; this passed unanimously. ADJOURNMENT With no further business before this April 10, 2006, regular session of the Weirton City Council, the meeting was adjourned after the prayer.
